CERC Eases Rules, Compliances For Generators, REC Certificates GERC Declines To Impose Charges For RTS Users Below 6kw

As part of its ongoing efforts to ensure ease of doing business, the Central Electricity Regulatory Commission (CERC) has come out with a suo-motu order on January 22, published on its site on January 24, that relooks some of the rules and compliances mandated for power generators. The new revisions cover rules linked to procedures, compliances, with a focus on making compliance less onerous, and procedure, simpler.

The commission considered  5 areas for improvement in this order. These are, along with changes made:

(a) Central Electricity Regulatory Commission (CERC) (Standards of Performance of Inter-State Transmission Licensees) Regulations, 2012
(i) Regulation 8 (regarding information to be furnished by the inter-State Transmission Licensees)

Changes made: Here, the commission has directed that the information as required under Clause (2) of Regulation 8 of the Standards of Performance Regulations may be submitted on yearly basis by 30th April for the previous financial year. This was earlier required to be done twice every year, at six monthly intervals.

(b) Central Electricity Regulatory Commission (CERC) (Procedures, Terms and Conditions for grant of Transmission License and other related matters) Regulations, 2009

Changes Made: Aligning itself with the new digital realities, the commission has mandated that  such information which was previously being submitted in physical form, may now be submitted to the Commission on its e-filing portal. The previous requirement of publication in newspapers shall be substituted by the provision for publication on the websites. The relevant application shall also be submitted in electronic form. This should lead to a reduction in costs for applicants of course.

(c) Procedure for Registration of a Renewable Energy Generator or Distribution licensee, as the case may be, issued by the Central Agency in pursuance of the Central Electricity Regulatory Commission (Terms and Conditions for recognition and issuance of Renewable Energy Certificates for Renewable energy Generation) Regulations, 2010 as amended from time to time

(d) Procedure for issuance of Renewable energy certificates to the Eligible entity by Central Agency, issued by the Central Agency in pursuance of the Central Electricity Regulatory Commission (Terms and Conditions for recognition of Renewable energy certificates for Renewable energy Generation) Regulations, 2010 as amended from time to time

(e) Model Procedure / Guidelines for accreditation of a Renewable Energy Generator or Distribution licensee, as the case may be, by the State Agency

For the last three, the commission has indicated that procedures have been shared with the National Load Despatch Centre with instructions to give it wide publicity from time to time to remove any ambiguity and make access easy for applicants.
