CERC Allows Adani Subsidiary Compensation For 'Change of Law' Events Inox Wind on Wednesday said the Appellate Tribunal for Electricity (APTEL) has reinstated a 50 MW wind energy project in Kutch being undertaken by its arm at a tariff of Rs 3.46 per unit. “Appeal No. 292 of 2021 filed by Wind Four Renergy Private Ltd (WFRPL), a wholly owned subsidiary of Inox Green Energy Services Limited (IGESL), (earlier known as Inox Wind Infrastructure Services Limited), has been allowed by Appellate Tribunal for Electricity (APTEL), New Delhi vide its Order dated 11th January, 2022,” it said in a BSE filing. Under the directions given in the order, the 50 MW (SECI Tranche-1) wind power project of WFRPL being undertaken in Kutch (Gujarat), which was awarded by SECI, has been reinstated at a tariff of Rs 3.46 per KWH. The wind project developer’s request for the same had earlier been denied by the Central Electricity Regulatory Commission (CERC) and Solar Energy Corporation of India (SECI). “We must record strong disapproval over the arbitrary and unreasonable denial of effective relief by the Central Commission and the attempt of SECI to reagitate the issues which have been adjudicated upon by an order which has become binding on SECI, there being no appeal brought by it there-against,” the tribunal said while reprimanding CERC and SECI. “We were inclined to impose costs on the respondents [CERC and SECI] for prolonging the adjudicatory process for the appellant [WFRPL] by above acts of omission and commission but refrain from doing so in the matter at hand in the hope that we shall not come across such unjust approach taken in future,” APTEL said.
